The use of the Website is also subject to these Terms and Conditions.

I. TERMS AND CONDITIONS OF USE AND SALE

1. INTRODUCTION AND OUR ROLE

  • 1.3. Service: We offer you a service through which you can place orders ('Orders') for food ('Products') at our restaurant ('Restaurants') which offers home delivery or for pick-up at the restaurant itself.

2. WEBSITE ACCESS AND CONDITIONS

2.1. Website Access: Most areas of this Website are open to everyone and can be visited and accessed without the need to place an order and/or register your data.

2.2. Acceptance of conditions: By accessing any part of this Website, you are accepting the Website Conditions. If you do not accept the terms and conditions of this Website, you must leave it immediately, and you will not be able to place orders through it.

2.3. Revision of terms: 2 ROCKS RESTAURANT may revise the Conditions of this Website at any time, so please check the content of these conditions regularly, as you will be subject to the terms and conditions in force at the time you place an order with us.

2.4. Responsibility: It will be your sole responsibility to carry out whatever is necessary to access the Website and to ensure that all persons accessing the Website through your Internet connection are aware of the Conditions of this Website, and comply with them.

3. YOUR STATUS

3.1. Capacity and Majority: By placing an order through the Website, you warrant that you have the legal capacity necessary to enter into binding contracts and are not under the age of 18.

3.2. Food Allergies and Intolerances: You acknowledge and agree that if you, or someone you are ordering food for, has a food allergy or intolerance, you will contact the restaurant directly to verify that the food they are preparing for you meets your needs before placing the order directly with them.

3.3. Alcohol and Cigarettes: In accordance with Law 11/2010 of December 17 on the prevention of the consumption of alcoholic beverages by minors, it is prohibited to sell alcoholic beverages to persons under 18 years of age, or by persons over 18 years of age to minors under 18 years of age. In accordance with Law 42/2010 of December 30, and Law 28/2005 of December 26, on health measures against smoking and regulating the sale, supply, consumption, and advertising of tobacco products, the sale of cigarettes to persons under 18 years of age is not allowed. Orders containing both alcohol and cigarettes cannot be accepted by persons under 18 years of age.

4. HOW TO PLACE AN ORDER AND HOW IT IS PROCESSED

4.1. Placing your order: Once you have selected the Products you wish to order from the menu of the chosen restaurant, you can place your order by clicking the 'place my order' or similar button. Please note that it is important to review the information you enter and correct any errors before clicking the 'proceed to payment' button as once you click on this entry, errors cannot be corrected.

4.2. Modification or cancellation of your order: Once you have placed your order and your payment has been authorized, you cannot cancel your order or request a refund. (for more details on order cancellation see section 4.4). If you wish to modify or cancel your order, you may contact us, as defined in section 6.3, to communicate the requested changes. However, we cannot guarantee that the restaurant will agree to your changes, as they may have already begun preparing your order.

Payment Authorization: If the payment made is not authorized, your order will not be processed or communicated to the restaurant.

4.4. Order management and possible rejections by the restaurant: Upon receipt of your order, 2 ROCKS RESTAURANT will process your request and send you an email notification that your order has been received and that your request is being processed. Please note that any confirmation page you may see on the Website and any order confirmation you may receive via email only implies that your order has been received and is being processed, but not necessarily that your order has been accepted. We try to accept all orders and attempt to immediately communicate any rejection of an order. We will attempt to notify you of the possible rejection of your order as soon as possible (usually by email), but orders can be rejected at any time, due to being too busy or due to weather conditions or for any other reason.

4.5. Delivery of your order: Estimated delivery and pick-up times are estimates only. We do not guarantee that orders will be delivered or available for pick-up within estimated times.

4.6. Completion of the order process: The contracting process will be completed when the order is delivered to you.

5. PRICE AND PAYMENT

5.1. VAT and Shipping Costs: Prices will be as indicated on this Website. These prices include VAT but exclude delivery charges, which will be added to the total amount owed where applicable (if you choose delivery instead of pick-up).

5.2. Incorrect Price Setting: This Website contains a large number of menus and it is possible that some menus may contain an incorrect price. If the correct price of an order is higher than the price set on the Website, 2 ROCKS RESTAURANT will usually contact you before the order in question is dispatched. In these cases, 2 ROCKS RESTAURANT is not obliged to deliver the order at the lower incorrect price or to compensate you for the price discrepancy.

5.3. Payment Methods: Payment for orders through the website must be made by a credit or debit card accepted by the restaurant or in cash at the place of delivery of the order.

5.4. Card Payments: When paying with a credit or debit card, you may be asked to show the card you used for payment at the time of delivery as proof of identification and so that the restaurant can verify that the card matches the data on the order receipt. Please note that there may be delays in the payment processing and operations process; which may result in delays of up to sixty (60) days in the debit from your bank account or the charge to your credit or debit card.

Rejected Orders: Due to standard banking practices, once you have placed an order by credit or debit card and the payment has been authorized, your bank or card issuer will hold the total amount of your order. If your order is subsequently rejected by the restaurant (as set out in section 4.4 above) or canceled for any other reason, your bank or card issuer will not transfer the payment amount to us, and instead will release the corresponding amount back to your account. However, this may take between 3 and 5 business days (or more, depending on your bank or card issuer). You acknowledge and agree that we are not responsible for any possible delay by your bank or card issuer in releasing the amount from your account.

6. CUSTOMER SERVICE

6.1. General: Customer service is very important to us. In accordance with paragraphs 6.5 and 11, we will try to resolve any issues you may have with your order. You can contact us by calling the telephone number on the Website.

6.2. Order Inquiries: If your order is taking longer than expected or if you have any other issues with it, you can contact us to follow up on your request.

6.3. Change or cancellation of your order: If you wish to change or cancel an order that has already been placed and whose payment has been authorized, you can contact us as indicated. However, we cannot guarantee that we will agree to accept your changes or cancellations, as we may have already begun processing your order.
